JD Vance Announces Sweeping Investigation Into Alleged Abuse of U.S. Work Visa Programs

Vice President JD Vance and the Department of Labor’s Inspector General have announced a sweeping investigation into alleged widespread fraud and abuse within U.S. work visa programs, describing the effort as part of a broader campaign to protect American workers, strengthen employment protections, and crack down on fraudulent immigration practices. The investigation, announced Wednesday during an anti-fraud event in Milwaukee, is expected to examine alleged misconduct involving employers, labor brokers, and organizations suspected of exploiting foreign workers while undermining fair competition in the American labor market.

Speaking at the event, Vance emphasized that the administration intends to ensure employment opportunities are available to qualified American citizens rather than businesses and individuals allegedly using fraudulent schemes to obtain financial advantages. He argued that abuse of employment-based immigration programs can disadvantage domestic workers, suppress wages, and create unfair conditions for companies that follow federal labor and immigration laws.

The vice president described the investigation as an important step toward identifying those responsible for exploiting the system. Federal officials have already issued dozens of subpoenas as part of the effort, signaling that investigators are examining potential violations involving multiple employers and employment sectors. The subpoenas are expected to help authorities obtain records, communications, financial information, and other evidence that could establish whether employers or labor intermediaries violated applicable laws.

According to Anthony D’Esposito, the Department of Labor’s Inspector General, the suspected schemes extend beyond ordinary immigration violations and may involve extensive financial misconduct. In comments reported by the New York Post, D’Esposito said investigators believe the alleged practices have cost the American medical industry hundreds of millions of dollars and affected other sectors that depend on foreign labor.

D’Esposito said the Labor Department’s Office of Inspector General had uncovered alleged schemes involving fraudulent employment applications, coercive wage-kickback arrangements, and labor practices designed to give businesses access to workers at below-market wages. Under such arrangements, employers or labor brokers may allegedly promise workers legitimate employment opportunities while subsequently requiring them to return portions of their wages or accept conditions that violate labor protections.

If proven, these practices could have serious consequences for both foreign workers and American employees. Foreign workers may become vulnerable to exploitation when their immigration status, employment authorization, or future visa opportunities depend heavily on a particular employer. Meanwhile, American workers could face increased competition from businesses that allegedly reduce labor costs through unlawful wage practices rather than through legitimate improvements in productivity or efficiency.

The investigation is also expected to examine potential connections between employment-based immigration fraud and more serious criminal activity. Investigators reportedly suspect that certain operations could involve forced-labor networks and human trafficking organizations. Such allegations raise concerns that fraudulent recruitment and employment arrangements may be used not only to circumvent immigration rules but also to control workers through threats, financial pressure, deceptive contracts, or other coercive methods.

Authorities will need to establish the facts in individual cases before determining whether criminal charges, civil penalties, or other enforcement actions are warranted. Nevertheless, the possibility that employment-based visa schemes could intersect with human trafficking has increased the significance of the investigation and may lead to greater cooperation among federal agencies responsible for labor standards, immigration enforcement, and criminal investigations.

One of the central areas of concern is the H-1B visa program, which allows eligible U.S. employers to hire foreign workers for specialty occupations that generally require specialized knowledge and at least a relevant bachelor’s degree or its equivalent. The program is widely used in industries such as information technology, engineering, healthcare, scientific research, and other professional fields.

According to assessments attributed to the Department of Homeland Security, as much as 21 percent of H-1B visa petitions may be fraudulent. That figure, if accurately characterized, would represent a substantial concern for federal regulators. However, it is important to distinguish between suspected or potentially fraudulent petitions and cases in which authorities have established fraud through investigations or legal proceedings. The percentage should not automatically be interpreted as proof that 21 percent of all H-1B workers or approved petitions are fraudulent.

The investigation will also examine possible abuses involving employment-based green cards, which provide qualifying foreign nationals with a pathway to permanent residence in the United States. Officials are expected to scrutinize allegations that some employers or intermediaries obtained immigration benefits through deception or used employment-based immigration arrangements in ways that unfairly displaced American workers.

Employment-based green card programs are designed to address legitimate employment needs while operating within federal immigration requirements. Depending on the applicable category, employers may need to demonstrate that positions are genuine, satisfy wage requirements, and comply with recruitment or labor-certification rules. Investigators will likely focus on whether employers submitted inaccurate information, misrepresented job opportunities, manipulated employment arrangements, or otherwise attempted to obtain immigration benefits improperly.

The findings could have significant implications for employers that rely on foreign labor. Companies found to have violated federal law could face financial penalties, restrictions on their ability to participate in immigration programs, or criminal prosecution where the evidence supports such action. Businesses may also face closer scrutiny of recruitment practices, wage payments, labor contracts, and relationships with third-party staffing agencies.

At the same time, enforcement officials will face the challenge of distinguishing fraudulent activity from legitimate participation in employment-based immigration programs. Hiring foreign professionals is not, by itself, evidence of wrongdoing, and allegations involving particular employers or labor brokers should not be generalized to all foreign workers or visa holders. A credible investigation will need to rely on documentary evidence, financial records, worker testimony, and applicable legal standards.

For American workers, the administration is presenting the initiative as an effort to strengthen wage protections and ensure that employers compete fairly. For foreign workers, effective enforcement could help identify exploitative recruitment practices and protect individuals who may have been misled or coerced by employers and labor intermediaries. The ultimate impact will depend on whether investigators can substantiate the allegations and whether enforcement actions lead to meaningful changes in workplace practices.

The announcement marks a significant escalation in federal scrutiny of employment-based immigration fraud. With dozens of subpoenas reportedly issued and several industries potentially affected, the investigation could expand as authorities examine employer records, labor-broker networks, and suspected violations involving both temporary work visas and permanent immigration benefits.

As the inquiry progresses, investigators will need to determine the scale of the alleged misconduct, identify the individuals and organizations responsible, and establish whether the suspected practices violated federal law. Any confirmed findings could influence future enforcement priorities and prompt additional oversight of employment-based immigration programs.

For now, the investigation remains an inquiry into alleged wrongdoing rather than a final determination that the suspected schemes occurred in every case. Its results could nevertheless shape the national debate over immigration enforcement, labor-market competition, worker protections, and the responsibilities of businesses that participate in U.S. employment-based immigration programs.
